The Federal High Court in Abuja has struck out a suit seeking to disqualify the All Progressives Congress (APC) and its presidential candidate, Asiwaju Bola Tinubu, from the 2023 general election.
In a judgement on December 23, Justice A.R Mohammed, dismissed the suit for being a misjoinder of causes of action.
He further held that the Plaintiffs lacked the locus standi to institute the suit having not participated in the presidential primaries complained of.
Suleiman had prayed the court to disqualify Tinubu from contesting for the nation’s No. 1 seat, claiming he presented a forged certificate.
Also in the suit FHC/ABJ/CS/ 1114/ 2022 filed by former Minister of State for Education, Emeka Nwajuba, Justice Abubakar dismissed the suit for being statute barred having been filed more than 70 days from the occurrence of the purported cause of action.
Nwajuba had asked the court to disqualify Tinubu for failing to provide his secondary school certificate. He also said the APC candidate failed to provide the source of the N100million he paid for the APC nomination form.
