Social media influencer and businessman Afolabi Kazeem Michael, known as KC Luxury, has asked the Federal High Court in Lagos to set aside a 30-day detention order granted to the NDLEA. He has been in custody since his arrest on August 13 in connection with a cocaine seizure of 184.5kg valued at N39 billion.
Through his lawyer, Abdulakeem Labi-Lawal (SAN), KC Luxury argued the detention order violates the Administration of Criminal Justice Act (ACJA), which permits an initial remand of no more than 14 days. He maintained that the court lacks jurisdiction to remand an uncharged suspect just to allow more time for investigation. The defence also questioned the legality of the ex-parte order obtained on August 20 from another judge, Justice Akintayo Aluko.
NDLEA lawyer Abu Ibrahim justified the remand, clarifying the order was obtained before KC Luxury approached the court. Justice Friday Ogazi adjourned the case to September 21 for further proceedings. KC Luxury is seeking N190 million in damages for alleged unlawful arrest, privacy invasion, and circulation of his custody photos.
