The Federal High Court’s decision disqualifying Tonye Cole, the All Progressives Congress candidate for governor of Rivers State, for violating the Electoral Act and suspected dual citizenship was overturned by the Court of Appeal in Port Harcourt on Friday.
The APC and the Independent National Electoral Commission were also parties to the lawsuit that the Peoples Democratic Party filed at the High Court.
The PDP was referred to as a “meddlesome invader” by the Court of Appeal.
In a unanimous ruling, the three-person appeals panel ruled that the PDP lacked the legal standing to challenge the APC, its governorship candidate, and INEC over how the congresses and primary elections that selected Cole as the candidate were conducted.
